Arizona Republicans Advance Measures To Defend Parental Choice

Arizona lawmakers moved late in the session to shield parental choice and choke off special privileges for teachers unions by advancing two constitutional amendments for the November ballot. The fight centers on protecting universal Education Savings Accounts from a union-backed initiative that would dramatically narrow eligibility and on stopping the state from acting as a collection arm for union dues.

Republicans pushed through measures to defend the statewide ESA program and to limit union access to payroll deductions. These steps came after the Arizona Education Association launched a petition drive aimed at rolling back broad eligibility for scholarships that many families rely on. Lawmakers framed their actions as protecting family choice from a sudden policy reversal backed by union power brokers.

The Protect Education Act that the union circulates would impose tight new limits on the program, including an income threshold so restrictive that it could kick out children of everyday public servants. More than 100,000 Arizona kids now use ESA dollars to attend schools that fit their needs, and the proposed cap would disqualify tens of thousands of current participants. That kind of abrupt change would shut the door on families who have found better options outside their assigned neighborhood schools.

On the surface the union has been confident, but behind the scenes its tactics suggested uncertainty about reaching the signature target. Reportedly, union leaders even floated a deal with Republican legislators as the session wound down. The willingness to barter indicates they might doubt the initiative’s legal strength or its grassroots momentum.

The debate became about who gets to choose a child’s school and who gets to lean on taxpayers when they can.

Union negotiators reportedly offered to pause their petition drive if the Legislature agreed to new restrictions on ESA usage, including mandated testing, caps on rollovers, and limits on allowable purchases. A version of that compromise made it to the Senate floor but failed by a slim margin. That rejection forced the union to keep using the initiative path if it wanted to change the program.

In response, Republicans advanced House Concurrent Resolution 2048 to put a constitutional amendment on the November ballot that would protect the ESA program. The referral passed along party lines in both chambers and, as a legislative referral, would go straight to voters without needing the governor’s approval. This move was positioned as a direct defense against back-door changes via ballot initiative.

It also declares that any law or measure in conflict with this protection would be void. If voters approve that language, the union’s ballot measure would be legally incompatible with the new constitutional guarantee.

Lawmakers also put a second amendment before voters to stop the state payroll system from collecting dues or other payments for teachers unions. The policy treats union fundraising like other political or advocacy activity that should not get automatic state-run collection help. That change forces unions to fundraise directly rather than leaning on taxpayer-run payroll tools.

These twin measures aim to preserve broad school choice while denying unions a taxpayer-funded shortcut for financing. The message from Republican leaders was clear: prioritize parents and students instead of institutional union power. Arizona voters will see a straightforward choice on the ballot in November and decide which direction they want for education policy moving forward.
