Abigail Zwerner was working in her Richneck Elementary School classroom in Newport News when a child pulled a gun and shot her in the hand and chest. She spent two weeks in the hospital recovering from the wounds that changed both her body and her life. The incident set off criminal investigations and a civil trial that examined whether school staff missed clear signs before the shooting.
The lawsuit accused former assistant principal Ebony Parker of dismissing warnings that could have stopped the event from happening. Colleagues had reported concerns, and Zwerner herself had said the student had been in a “violent mood” and had threatened another child. Another teacher told administrators that students reported the boy had a gun in his backpack, claims that did not apparently prompt the response many argue was needed.
The jury sided with Zwerner and awarded her $10 million in damages, a verdict that sent a strong message about responsibility inside schools. Parker reportedly showed no reaction when the decision was read in court. Outside the courthouse, one of Zwerner’s attorneys said hearing the jury’s judgment reinforced the belief that the tragedy could have been avoided.
At trial, Zwerner and her legal team argued that an allegation of a firearm on campus should have shut everything down and demanded investigation. “A gun changes everything. You stop and you investigate. … You get to the bottom of it to know whether that gun is real and on campus so you can deal with it. But that’s not what happened.” That exact line captured the core of the plaintiff’s argument and was repeated in court to underline the alleged failure to act.
During testimony Zwerner described the terror and disorientation she felt in the moments after being shot. “I thought I had died,” she said. “I thought I was either on my way to heaven or in heaven. But then it all got black, and so I then thought I wasn’t going there.” Those words gave jurors a raw glimpse into the personal cost of the event and why accountability mattered so much to her case.
The criminal side of the story moved separately. The child’s mother, Deja Taylor, faced federal firearm and drug convictions and received a prison sentence that included 21 months for the firearm charges and an additional two years related to child neglect. The young shooter was never charged due to his age, and the family issued a statement describing him as suffering from an “acute disability.” There were also emotional claims from family members suggesting the broader public focus on the case had other motivations.
Parker has faced criminal charges, including eight counts of felony child abuse alleged to correspond to the number of bullets in the gun, and the civil award carries interest that begins to accrue as of June 1, 2024. The verdict and the parallel criminal matters have generated debate about school safety, reporting procedures, and the balance between individual accountability and systemic failure.
