Jack Smith Could Be Blocked From Using Evidence Against Trump

Special Counsel Jack Smith may encounter challenges in using evidence from grand jury investigation files against Donald Trump concerning the former president’s Florida case involving classified documents.
The evidence, gathered in 2023 by a Washington, D.C., grand jury and including testimony from figures such as Trump’s attorney Evan Corcoran, is being scrutinized for possible charges related to mishandling classified materials.

Trump and others were indicted in Florida instead. As per federal regulations, the grand jury files were transferred to Judge Aileen Cannon’s jurisdiction, who was appointed by Trump, on Monday.

Legal analyst Bill Shipley pointed out that this transfer gives Cannon control over the grand jury testimony, potentially affecting Smith’s case as she is not bound by previous rulings in the Washington, D.C., court.

Shipley elaborated on X, previously known as Twitter, that due to the case moving to Florida, Cannon has the authority to dismiss certain grand jury testimonies, such as Corcoran’s, if she believes they violate attorney-client privilege.

Corcoran appeared before the grand jury for classified documents in Washington, D.C., on March 24, 2023, marking his second testimony.

He was called to testify after he wrote a letter in June 2022 confirming efforts to locate classified documents, which were later discovered on Trump’s property.

Shipley mentioned that Cannon may prevent prosecutors from using evidence obtained in a way she deems inappropriate. Special Counsel Smith announced on Monday that the grand jury files had been transferred to Cannon’s jurisdiction.

Trump is facing 40 federal charges related to mishandling sensitive materials from his Mar-a-Lago estate in Palm Beach, Florida.

The allegations involve hindering federal authorities in their attempts to retrieve the documents.

Trump, along with his former valet Walt Nauta and Mar-a-Lago maintenance manager Carlos De Oliveira, have all pleaded not guilty to the charges, including conspiracy to obstruct justice.

A sealed order from Washington, D.C., permits potential public disclosure of specific case materials, giving Cannon the authority to decide on releasing grand jury testimony if she considers it appropriate.

“Trump, unlike Biden, is alleged to have engaged in extensive and repeated efforts to obstruct justice and thwart the return of documents bearing classification markings, which provides particularly strong evidence of willfulness and is a paradigmatic aggravating factor that prosecutors routinely rely on when making charging decisions,” Smith’s team wrote.

On Monday, Smith provided the judge and defense counsel with proposed redactions for documents, suggesting that there is a possibility of the grand jury documents being disclosed to the public in the future.

    Trump, unlike Biden, had the authority to have his documents, AND to declassify ALL of them WITHOUT ‘authorization’, because the president has no one above him TO authorize it. Trump was a president, Biden wasn’t when he took documents home. But Biden walks because he’s ‘old’…Trump goes to court.

    Smith, a lawless thug shows no respect for the law he is suppose to represent. He uses the law for his own personal agenda by expanding the law to fit his needs. These false, fake allegations are on life support & Smith knows it.
    Now, he will try whatever he can to keep it going. He should be fired along with Garland, Wray. We want our country back not this sick stuff that goes on under Biden who is the worse president in our history followed by Obama.

      Exactly. Garland should be impeached for illegally appointing Smith because Smith isn’t qualified to be a ‘special council’, and Smith should be fired and indicted for accepting the position when he knew it wasn’t legal for him to do so.

    Mr. Smith is just an extension and direction of an old man, Mr. Garland, who didn’t get what he wanted from President Trump, a position on the Supreme Court. How, Mr. Garland and Mr. Smith wants is revenge on President Trump and to use the former President for their own gains. In other words, all the court crap and proceedings are made up lies and charges. None of the prosecutors against President Trump are honest and only care about themselves. Each, and all, should be disbarred for the way they have acted. Too bad they have forgotten that they should be fair and honest.

    I think the whole lot of shister lawyers, AG’s and judges with ties to George Soros should be tried and disbarred. So many corrupt liars and politicians are all after one man because the Democratic machine knows they can’t beat him in an honest and fair manner. He ha exposed them to we the people and we are tired of the lies and corruption in our government. George Soros and his son should be investigated and deported and should not be allowed in the US A. He , George Soros should be investigated for election interferience .
