The Biden administration’s Justice Department introduced the “Engaged in the Business” Final Rule on Thursday, aiming to redefine the criteria for individuals selling firearms.
This rule broadens the requirement for a federal firearms license to include those selling guns for profit at shows and online.
Critics argue that this move is an overreach by the Biden administration, encroaching on Second Amendment rights.
Attorney General Merrick B. Garland asserts that making a profit from gun sales, regardless of where they occur, necessitates licensing and background checks.
“Under this regulation, it will not matter if guns are sold on the internet, at a gun show, or at a brick-and-mortar store: if you sell guns predominantly to earn a profit, you must be licensed, and you must conduct background checks,” said Attorney General Merrick B. Garland. “This regulation is a historic step in the Justice Department’s fight against gun violence. It will save lives.”
The Final Rule aims to close the so-called “gun show loophole,” ensuring that all gun dealers, regardless of where they sell firearms, comply with federal background check requirements.

In June 2022, the Bipartisan Safer Communities Act (BSCA) broadened the definition of individuals engaged in firearms dealing, a measure endorsed by Executive Order 14092 issued by President Biden.
This marked the first significant federal gun control legislation passed in almost three decades.

It’s interesting how these dolts say “This regulation is a historic step in the Justice Department’s fight against gun violence. It will save lives.” and yet, all we see is increases in crime and the loss of life. Maybe we should be going in the opposite direction and ban all of these unconstitutional gun regulations and stop criminalizing innocent gun owners and sellers.
