House Republicans are turning up the heat on prosecutors who have drawn fire for soft immigration enforcement, with Rep. Jim Jordan putting county DAs on notice that subpoenas are very much in play. At the center of the fight is Fairfax County Commonwealth’s Attorney Steve Descano, whose office has faced scrutiny over policies critics say put illegal immigrants ahead of public safety and common sense.
Jordan, who chairs the House Judiciary Committee, is digging into district attorneys in so-called sanctuary jurisdictions and looking closely at whether they considered immigration status when making charging decisions. The concern is simple and blunt: if a suspect is in the country illegally and also accused of a serious crime, should that status be part of the prosecutorial decision at all? To Jordan and his allies, the answer is that local prosecutors should not be bending over backward to shield people who break the law.
Jordan said the committee is trying the usual route first, asking for documents and working with local offices before escalating. But he made it clear that if prosecutors stonewall, Congress can force the issue. “If we have to, we’ll use subpoenas to get the documents that we think they may not be giving us. There’s a process we always go through. We ask for things, we ask again, we explain why, we work with their office — in some cases their counsel — and back and forth,” Jordan explained in an interview with Fox News Digital. “And then if we have to use subpoenas, we certainly will do that … but we want to know the facts.”
Fairfax County has become a flashpoint because of Descano’s approach and the tragic case involving Stephanie Minter, a 41-year-old U.S. citizen who was stabbed to death. Her accused killer, Abdul Jalloh, reportedly entered the country illegally from Sierra Leone in 2012, and DHS said he had been arrested more than 30 times before the killing. That kind of record is exactly why Republicans argue sanctuary-style policies are not some harmless political slogan, but a real-world threat.
Descano has led the Fairfax County District Attorney’s Office since January 2020, and his critics say he signaled early that immigration consequences should weigh into plea deals and charging choices. According to reporting cited in the controversy, guidance from that year encouraged prosecutors to consider the “collateral immigration consequences” of charges where possible. That has fueled the argument that the office was not just passively ignoring federal immigration concerns, but actively factoring them into criminal decisions.
Fairfax County’s sanctuary status only sharpens the clash. In a jurisdiction where local law enforcement is not required to cooperate closely with federal immigration authorities, opponents say the system invites confusion and lets dangerous offenders slip through the cracks. Jordan argued that is especially reckless in a major Washington, D.C. suburb, where public safety problems can quickly spill into a national security concern.
“This is one of the dumbest policies I’ve ever heard of. You’re going to tell local law enforcement not to work with federal law enforcement when it comes to enforcing federal law?” Jordan said. He went on to criticize prosecutors he believes are releasing “bad guys” and treating immigration status as a shield instead of a red flag, adding that these decisions can lead to predictable consequences.
The Fairfax case is not the only one drawing attention. Jordan pointed to other prosecutors in big blue cities, including Manhattan District Attorney Alvin Bragg and Philadelphia District Attorney Larry Krasner, as part of a broader pattern. Republicans see a common thread in these offices: aggressive politics, soft-on-crime instincts, and a willingness to put ideology ahead of order.
Descano’s political backing has also become part of the debate, especially because his 2019 campaign received money from a PAC with billionaire George Soros among its supporters. That detail has made him a familiar target for conservatives who argue that progressive prosecutors across the country are being bankrolled to weaken the justice system from within. The result is a high-stakes showdown that is now moving from local courthouses to Capitol Hill, where House Republicans are signaling they are not ready to let the matter fade.
