Supreme Court VRA Rehearing Could Give Republicans 19 Seats

A Supreme Court decision tied to the Voting Rights Act could shift control in the U.S. House. A recent report says the case on the justices’ docket might give Republicans as many as 19 additional seats. That would be a big change for a party currently holding a narrow majority.

Even a handful of flipped districts changes who sets the agenda in Washington. More seats for Republicans would mean stronger leverage to advance policy and block what conservatives see as harmful spending and regulations.

The fight centers on Section 2 of the Voting Rights Act and how courts handle claims about racial vote dilution. At stake is whether judges will continue the current standard or narrow the law’s reach when assessing how maps are drawn.

Ahead of the court’s Oct. 15 rehearing of Louisiana v. Callais — a case that has major implications for the VRA — two voting rights groups are sounding the alarm, warning that eliminating Section 2, a provision that prohibits racial gerrymandering when it dilutes minority voting power, would let Republicans redraw up to 19 House seats to favor the party and crush minority representation in Congress.

If this were all to come to pass, then Politico notes that it would “all but guarantee Republican control of Congress.” The 19-seat number is an estimate that depends on mapmaking, legal choices, and how courts interpret any ruling.

Politico also notes that “a ruling in time for next year’s midterms is unlikely.” Although, the outlet also claimed that “it’s not out of the question.”

Timing matters because redistricting is a practical, state-by-state process that can be slowed by lawsuits and appeals. Even with a favorable ruling, implementation could take time and face further court challenges.

We are already seeing intense redistricting battles across the country, and Republicans have managed to translate legal theory into real gains. Lawmakers in several states are seizing opportunities to redraw lines and protect or expand GOP representation.

Last month, for example, the Missouri legislature redrew its congressional maps in such a way as to net a seat for Republicans in the U.S. House of Representatives.

Republicans have also had success in Texas, where they are expected to gain about 5 seats in the House thanks to newly-drawn maps. Democrats, though, are mounting defenses in states like California and Illinois to try to blunt those changes and protect their own majorities.

Expect legal filings and statehouse fights to keep this dispute in the headlines as both sides push for maps that favor them.
