Micki Witthoeft, mother of Ashli Babbitt, has been actively protesting in Washington, D.C. since her daughter’s tragic death on January 6. The Trump Administration is reportedly moving towards settling the wrongful death lawsuit filed by the Babbitt family against the U.S. government. Judicial Watch was the organization that initiated this lawsuit.
According to the U.S. District Court of the District of Columbia, a statement was released regarding the ongoing lawsuit. The Gateway Pundit has been following this case closely since it was first filed in January 2024. The lawsuit sheds light on alleged incompetence and prior incidents involving Officer Michael Byrd, the Capitol Police officer responsible for the fatal shooting of Babbitt.
Officer Byrd’s history includes failing to meet firearms qualification requirements and leaving a loaded firearm in a Capitol Visitor Center bathroom. In another incident, he reportedly fired into a moving vehicle driven by teenagers, with his bullets allegedly hitting nearby homes. The lawsuit claims that “Lt. Byrd had a reputation among peers for not being a good shot.”
Judicial Watch has filed a $30 million wrongful death suit over the death of protester Ashli Babbitt on January 6. The lawsuit further alleges that “Lt. Byrd later confessed that he shot Ashli before seeing her hands or assessing her intentions or even identifying her as female.” It is emphasized that Ashli was unarmed and had her hands visible.
A memo received by Judicial Watch recommended declining criminal prosecution against Byrd, noting that he did not document the shooting. Micki Witthoeft expressed concern over the lack of oversight within the Capitol Police Department. She criticized their tendency to “choose not to” report incidents, comparing it to a dog blaming a cat for getting into the trash.
Witthoeft recalled an incident in the Canon Congressional Office Building where she had to wake up a sleeping officer to pass through security. This incident underscored her concerns about accountability and professionalism within the department. Years after her daughter’s death, the Trump administration signaled an intention to resolve the case.
The potential settlement of the lawsuit has brought renewed attention to the circumstances surrounding Ashli Babbitt’s death. Many conservatives see this as a step towards justice for the Babbitt family. The resolution of this case is being closely watched by various conservative news outlets.
Paul Bedard of the Washington Examiner reported on the progress of the lawsuit. The parties involved have agreed to work together to address or settle the issues at hand. This cooperative approach could lead to a resolution that satisfies all parties.
Witthoeft remains a vocal advocate for her daughter, seeking accountability and transparency. She continues to call attention to what she perceives as failures within the Capitol Police. Her efforts have resonated with many who share her views on government accountability.
The lawsuit has highlighted questions about the actions of Capitol Police on January 6. Conservative commentators have used the case to critique broader issues related to government oversight. The settlement talks may represent a turning point in the ongoing debate.
The death of Ashli Babbitt has become a significant topic among conservative circles. Many see her as a martyr for their cause, sparking calls for justice and accountability. The lawsuit’s potential settlement could be seen as a victory.
The Babbitt family’s pursuit of justice has garnered support from various conservative media outlets. These outlets have consistently covered the case, amplifying calls for accountability. The family’s legal battle has become emblematic of broader concerns among conservatives.
As the lawsuit progresses, the details of the settlement remain under scrutiny. The case has prompted discussions on law enforcement practices and accountability. The outcome may have implications for similar cases in the future.
The Ashli Babbitt case remains a focal point for many conservatives seeking justice. Her death has become a rallying cry for those questioning government actions. The settlement talks suggest a possible resolution is on the horizon.
The legal proceedings have brought attention to issues of oversight and accountability. The outcome of this case may influence public perceptions of law enforcement actions.
The Babbitt family’s determination has kept the case in the public eye. Support from conservative figures and media has bolstered their efforts. As the lawsuit moves forward, many await the results.

The person who shot Babbit should also be sued for her death. Why should the shooter go scot free as he is the one who pulled the trigger! ! ! ! ! ! ! !
Wut? You can’t mean that this ‘anointed hero’ should be held accountable, shurly thou dost jest! 😉 The latest info seems to indicate that this ‘killer’ is still employed and ARMED. If I’m one of his comrades in arms, I would never let this whack get behind me!
““Lt. Byrd later confessed that he shot Ashli before seeing her hands or assessing her intentions or even identifying her as female.” It is emphasized that Ashli was unarmed and had her hands visible.” More verification that my ‘learned theory’ is more than viable! I posted the following in response to several articles:
“….an officer may use deadly force only when the officer reasonably believes that action is in the defense of human life, including the officer’s own life, or the defense of any person in immediate danger of serious physical injury,” REVEALING! This officer, in what way, thought his life or the life of another was in danger from some 130 lb UNARMED woman? Below is what anyone schooled in the use of ‘lethal’ weapons would tell you after viewing just the side view of that shooting:
Everyone, but especially anyone “investigating” this shooting, should view the video Laura Ingraham presented on her program. It clearly showed the shot that killed the AF Vet. The shooter is a black man, recently reported to be the same Lt. on the Capitol Police unit that left his loaded, untended, firearm in a Capitol restroom. The following is ‘my theory,’ and if true a possible reason little has been forthcoming about this “shooting.” My thinking is based on being involved with firearms my entire life, including a 20-year career in the Marine Corps. In that video, you initially see the ‘shooter’ pointing his handgun at people to his right that is closest to him. He then swings his arms/aims to the left towards his center and just as he stops that movement the shot is made striking the unarmed Vet (in the neck, not “center mass” as instructed!). There is much to know about what is going on in this sequence. When you play the video in slo-mo, you can see the shooter, even in his initial aim, before starting to change the point of aim, has his trigger finger fully engaged with the BOOM actuator (trigger). This single fact is a violation of proper handgun operation/safety! Unless you are immediately prepared to destroy what you are aiming at, intending to shoot, that finger remains OUTSIDE the trigger guard resting on the slide NOT even the guard. WHY? Because when ON that trigger you are +-5 lbs of pressure from releasing something you CANNOT CALL BACK! The human body pumps out a HEAVY dose of adrenaline when perceiving a possible Life or Death encounter, even folk having experienced such still have to deal with that. Two things are guaranteed, especially for a first-timer, you get tunnel vision and lose fine motor skills (amount of ‘felt’ pressure being applied to a firearm’s trigger), that adrenaline rush that is married to the fight or flight response. I contend that this gunny did NOT INTEND to shoot the woman, and probably was not even aware that he had released the shot, until the felt recoil. This Lt. was so amped up that swinging that handgun and stopping it was all the extra, unfelt, pressure needed to launch that un-recallable shot! BTW, this is by far NOT the first time an ‘unintentional discharge’ under duress has occurred. To illustrate: Three police officers had a suspect captured, two officers had him face down on the concrete, hands behind his back, applying the cuffs. The third officer standing about 8-10 feet away was pointing her weapon in the direction of the three, her two pals, and the perp, who was now all but in handcuffs. The real “gunnies” of us watching the video were waiting for the BOOM! WHY? That officer still pointing toward the action of the three had ‘her BOOM actuator’ fully on that bullet launcher. She also appeared to be still amped up over whatever went down in getting this perp down, and the BOOM came – by God’s Grace, nobody got dead or even shot, the bullet hit the concrete just slightly in front of and to the right of those three still on the ground! Hopefully, that officer only rides a desk unarmed!! Hated phrase, the bottom line for this shooter is, at what point did he think ‘his life was in immediate mortal danger’ that would have induced him to “intentionally” discharge that weapon? That is what every CCW licensee would HAVE TO articulate to a judge if, God forbid, we have to shoot anyone!! Further info has been revealed about this Officer. He is reported to be the same officer that had left his loaded firearm in the Capitol building men’s room, only retrieving the weapon when discovered by another individual. There is at least one photo of the Officer carrying a load of paperwork(?) in his left arm, walking, with his firearm drawn and held in his right hand before he shoots the AF Vet – the view indicates his finger is already engaged with the trigger, and his fellow officers in ‘front’ of him are unknowingly in real danger! Ashli Babbitt’s life may have been spared at the expense of a Capitol Police officer’s life if this incompetent officer had stumbled or fallen, or just INADVERTENTLY mashed that trigger. All indicators say that this “officer” is still on the job, ARMED, but should ONLY be riding a desk UNARMED, and at best facing the same charges the female officer who mistook her firearm for her taser which resulted in the killing of a resisting perp! As far as ‘believing’ this was any kind of useful investigation of a ‘wrongful killing’ of an unarmed individual, can we suppose a ‘coverup’ for another “DEI” hire? As John Stossel would say, “GIVE ME A BREAK!”

Firewagon; I agree with your detailed and expert analysis of such a scenario and all of the factors that you brought into play are so critically important to bear in mind for anyone that uses firearms especially in law enforcement or security where the situation can be a high Adrenalin one! I haven’t watched any video of the shooting and killing of Ashli Babbitt lately but I do recall a video I had found online just a day or two after it occurred and Officer Bryd was approaching the door that appeared broken that Ashli was climbing through being helped through that opening by a couple of guys just to her sides and behind! Byrd was concealing himself approaching along a wall in the corridor leading up to that door and had his weapon pointing directly at her and as she just got fully into that opening and was almost all the way through he took dead aim and fired without any hesitation or calling out to stop! I don’t know enough detail for sure but from what I saw in that video I sure thought he murdered her because the shot wasn’t necessary at all! This is the same guy that fired his weapon on another occasion into a car loaded with teenagers and the bullets although not striking them actually hit homes close by and he was also known to be a bad shot! I think Ashli died by extreme prejudice by a Police Officer that had issues and that guy was wrong so should be in prison! He sure fits the bill of being reckless and moreover a very dangerous ass that had no business running around in public with firearms in any circumstances! Perhaps it could be called negligent homicide? Manslaughter resulting from his itchy trigger finger? Not knowing his psych profile at the time maybe it was even straight out murder, all possibilities have to be examined!
I also commented on this site about my thoughts on Ashli’s demise!
This isn’t the Genuine America of years gone by, but is close to being a “Socialist Nazi Shithole” if it isn’t already!
Ashli Babbitt was blown away at point blank range on J6 in the U.S. Capitol when Officer Michael Byrd, a Capitol Police officer who admits he didn’t see Ashli’s hands nor know what threat she posed if any, but shot to kill anyway, basically an unarmed woman who was not endangering anyone! This same man among his peers was known to be a bad shot and had been reprimanded for many infractions in conducting his duties, even shooting into a car loaded with teenagers and the bullets hitting nearby homes! Ashli’s family is suing the Government but the actual man that pulled the trigger and killed her has been shielded by the government so isn’t being sued and has actually received compensations since the incident for all of the aggravation it caused him, like he was some victim!
Ashli was a 3 tour Veteran of the USAF and a fine mother and wife but after her death the Government under the evil Biden/Harris regime along with the MSM treated her and the incident like a nothing burger or event! But here now with Tina Peters we see a case of an obviously good woman and concerned patriotic citizen who was only concerned about a probable issue with those Dominion voting machines. Which I myself have major concerns about too; and if I worked a similar position that she did I would probably do the same thing to help maintain voting integrity!
But I quote; “Peters simply took steps to safeguard election security and expose potential vulnerabilities in Dominion voting machines. She had every reason to be concerned, as American voters have growing doubts about the integrity of the electoral process. Acting with the public interest in mind, she created forensic images of these machines before an unsanctioned and highly suspicious software update pushed by the Colorado Secretary of State’s office.”
“For this, Peters was vilified, targeted, and ultimately convicted on trumped-up charges of attempting to influence a public servant, conspiracy to commit criminal impersonation, and official misconduct. These charges are a transparent attempt to make an example out of her and to send a chilling message to anyone who might consider standing up to an increasingly authoritarian government.”
This woman did nothing to deserve this horrible treatment and this is absolutely a Major Travesty of Justice being a massive Injustice to torment and punish her this way! And I state that all who brought this action against her belong in prison, just like Officer Michael Byrd does for murdering Ashli Babbitt, and he didn’t even get a slap on the wrist let alone get nine years in prison like they’ve done to Tina Peters! This “contrast” of how such matters are handled in the current “very sketchy” “U.S. Judicial System,” is evidence enough that “political factions” and a “Socialist Nazi Marxist” undercurrent is at work in America destroying it, and all that’s been good about America for centuries!

“….he didn’t even get a slap on the wrist let alone get nine years in prison like they’ve done to Tina Peters!” Roger that. WORSE, the ‘killer’ was promoted and gifted money, touted a HERO by more than one “Representative!” Even, as I maintain, and contrary to this whack’s own claim, this ‘gunny’ did not intend to shoot Ashly, and experienced an unintentional discharge of his weapon. As shown in the video, that was aired on the Laura Ingram “Angle” program. Running that video in slo-mo, shows the shot initiated at the same moment that Byrd ‘stops’ the swing of his aim, from people to his right, to his center, and hits Ashli in the neck! Even given the ‘unintentional’ shot, Byrd should be facing the same consequences that the woman police officer did when she mistook her firearm for her taser, and killed a ‘resisting arrest’ perp. She went to JAIL on various charges! At a minimum, and for the protection of the general populace, this incompetent ‘gunny’ should NEVER be allowed to be armed!
