Ted Cruz Criticizes Witness Advocating for Oil Execs’ ‘Homicide’ Charges

Republican Texas Senator Ted Cruz made headlines when he took a strong stand against a proposal that left many scratching their heads. The proposal suggested that oil company executives could be prosecuted for climate-related deaths, sparking a heated discussion during a Senate Judiciary Committee hearing. Cruz, known for his forthright opinions, questioned the logic behind holding these executives criminally accountable for climate change impacts.

David Arkush, director of Public Citizen’s climate program and author of a provocative paper, was at the center of this debate. His paper, titled “Climate Homicide: Prosecuting Big Oil For Climate Deaths,” suggests a direct link between fossil fuel companies and climate-related fatalities. Arkush’s appearance before the committee was met with skepticism from Cruz, who found the idea of prosecuting energy leaders quite radical.

During the hearing, Cruz pressed Arkush for clarity on his assertions. “You argue that oil and gas executives could be prosecuted — not just sued, but criminally prosecuted — for homicide, for murder, based on climate change,” Cruz stated, seeking confirmation. Arkush acknowledged Cruz’s interpretation, though he attempted to clarify the legal nuances, emphasizing the technicalities of the term “murder.”

Arkush’s explanation did little to sway Cruz, who found the notion of prosecuting job creators absurd. Cruz highlighted the significant role energy executives play in the American economy, noting the millions of jobs they support. He questioned the rationale behind targeting these leaders with criminal charges, painting the proposal as an extreme measure.

Arkush maintained that some level of accountability might be appropriate for certain executives. However, Cruz dismissed this as a “moonbeam wacky theory,” suggesting it was an unfounded attack on a vital industry. The senator’s comments underscored his commitment to defending energy companies against what he perceives as unjustified legal assaults.

In response to such proposals, Cruz has been proactive in legislative efforts to protect the energy sector. In May, he introduced the Protect LNG Act of 2025, designed to shield liquefied natural gas (LNG) developments from disruptive lawsuits. The proposed legislation would restrict federal courts from overturning existing LNG permits and streamline legal processes. By mandating that lawsuits be filed in local federal courts within a 90-day window, Cruz hopes to prevent frivolous legal challenges. Cruz’s legislative push comes amid actions by the Biden administration to limit LNG export terminal approvals. In January 2024, the administration paused new approvals, drawing criticism from those who see LNG as crucial to America’s energy independence. The U.S. has become a global leader in LNG exports, a remarkable turnaround from projections of being a net importer just over a decade ago.
