Senate Parliamentarian Rejects Immigration Fees and Fast-Track Deportations in Major Bill

The Senate parliamentarian has determined that several immigration enforcement measures cannot be part of the proposed legislation known as the Big Beautiful Bill. Elizabeth MacDonough, the Senate Parliamentarian, stated that these measures would need a 60-vote majority to be included. Key measures affected include mandatory fees for asylum applications and the diversity visa lottery.

Applicants seeking asylum would face a mandatory fee of $1,000 under the proposed legislation. Additionally, a $100 fee would be required to request a continuance in immigration court. The diversity visa lottery would also see new fees, with a $250 charge for entering the lottery and $400 for processing applications.

Sponsors of unaccompanied alien children would have to post a $5,000 bond. The bill also seeks to broaden the expedited removal of criminal noncitizens. Despite these setbacks, the parliamentarian did allow for a provision tying a ten-year AI moratorium to increased funding for the BEAD program.

Senate Budget Committee Ranking Member Jeff Merkley expressed his satisfaction with the removal of certain elements from the bill. He emphasized that the fight is not over, as Democrats continue to challenge provisions that they believe violate Senate rules. Merkley criticized Republicans for attempting to pass what he called a “Big, Beautiful Betrayal” of a bill.

Merkley stated, “We have been successful in removing parts of this bill that hurt families and workers.” His comments highlight the ongoing partisan battle over the legislation. Democrats are committed to scrutinizing any changes to ensure compliance with reconciliation rules.
