Emily Moreno’s lawsuit against Rep. Max Miller adds another ugly layer to an already bitter family and political fight. The filing centers on claims that a sensitive image of the couple’s young daughter was shared online, while the broader dispute still hangs over Miller’s House race and public standing.
The case landed on Wednesday and quickly turned heads because of what it alleges: that Miller uploaded a nude photo of the child and made it available through a Dropbox folder that spread far beyond the original circle of people involved. According to the complaint, the image ended up being viewed more than 400,000 times after the folder link was posted publicly.
Moreno, who is Sen. Bernie Moreno’s daughter, has been locked in a tense custody fight with Miller since the breakup of their marriage. Her lawsuit says Miller “recklessly published and disclosed to the world a nude image” of their two-year-old daughter, a claim that puts the dispute in especially disturbing territory.
The filing also says the photo was handed to Miller’s attorney, Aaron Minc, along with other material tied to his defense against domestic abuse accusations. Minc later said he took full responsibility for the Dropbox contents and called the release of the image “completely unintentional.”
That explanation did little to calm the backlash. Miller reportedly shared the Dropbox link publicly on social media, which is the kind of move that can blow up fast and leave almost no room for damage control once the internet gets hold of it.
The lawsuit argues that the risks were obvious from the start, especially in an age when once-private material can be copied, altered, and weaponized in seconds. It says Miller should have known better than to place a child’s nude image in a public online space where anyone could find it.
This lawsuit is separate from the domestic abuse allegations Moreno has already made against Miller, and those claims are no less severe. She has accused him of throwing boiling water at her, holding a gun to her head, and possibly breaking their daughter’s collarbone, allegations Miller has denied across the board.
For Miller, the legal and political pressure is piling up at the same time. He has stayed in the race for Ohio’s 7th Congressional District, and after the election deadline passed, he was effectively locked in as the GOP nominee.
The situation also pulled Sen. Bernie Moreno directly into the drama after he broke his silence and urged his former son-in-law to step away from Congress. He described Miller’s behavior as increasingly “erratic and dangerous,” a sharp public rebuke that made clear how far this family fracture has gone.
What makes the whole mess harder to ignore is the way private pain, legal warfare, and public office have all collided at once. Miller is still defending himself, Moreno is still pressing her claims, and now the fight has moved into a courtroom where the stakes reach well beyond politics.
