Joe Biden Sues To Stop Release Of 2017 Interview Tapes

Joe Biden has filed suit to stop the release of roughly 70 hours of audio and transcripts from a 2017 interview series, arguing the material is being sought for political reasons; the Heritage Foundation pushed the Freedom of Information request after the recordings were collected by a special counsel, and the dispute has reignited criticism from Republican figures and a heated response from former President Trump.

This lawsuit is about more than dusty tapes. The Heritage Foundation asked for audio and transcripts from conversations between Joe Biden and writer Mark Zwonitzer, recorded while Zwonitzer worked on a book about Beau Biden. Those files ended up in the hands of then-special counsel Robert Hur during an investigation into alleged mishandling of sensitive materials, and now the White House is trying to block their release.

Biden’s legal team says releasing the recordings would be politically motivated and serve no public good. “The DOJ themselves have said these tapes serve no public interest. What’s happening now isn’t about transparency. It’s about politics,” said Biden spokesperson TJ Ducklo in a statement. They argue that letting the tapes loose would only fuel partisan attacks rather than inform voters.

There are about 70 hours of material at stake, a lot of tape for anyone to wade through. Conservatives point to memory lapses Biden displayed during earlier interviews and investigations and say these recordings could offer more context or confirm worrying patterns. Republicans have repeatedly used earlier episodes to question Biden’s fitness and decision-making, and this new dispute gives them fresh grounds to press that argument.

Much of the footage stems from interviews Biden gave to Mark Zwonitzer while discussing personal loss and family history after Beau Biden’s death. The intimacy of those sessions makes the stakes feel different to some people, but critics argue that whatever the context the recordings could still reveal inconsistencies relevant to national security or public trust. The files moved into federal hands during Hur’s review into the handling of classified material, which is why the argument about release centers on government transparency versus political targeting.

Legal teams for Biden say the request is not about public interest and that the tapes were gathered for a different purpose long ago. “If this administration were genuinely committed to transparency, they would release Volume 2 of Special Counsel Jack Smith’s report on Donald Trump’s own alleged mishandling of classified documents,” Ducklo added. That line ties the current fight into the broader back-and-forth over classified material and special counsel reports that has dominated headlines.

On the other side, Republicans argue the public has a right to see anything that bears on a president’s handling of sensitive information. They point to earlier reports and instances that they say raise real concerns about memory and judgment. Critics have seized on moments in prior interviews where Biden struggled to recall specifics, pushing the narrative that those lapses are not isolated and deserve scrutiny.

‘The man was grossly incompetent.’

Former President Donald Trump wasted no time weighing in and slammed Biden’s move as a cover-up. “A Crooked Politician!!!” Trump said in reaction to the filing. When asked by a reporter to comment at the White House, Trump expanded: “The man was grossly incompetent, and the Democrats — I call them the Dumocrats because their policy is so bad — but they came very close to destroying our country. We can never let it happen again, and I hope that you’re able to produce that,” said Trump to the reporter. “It would be very interesting reading for people,” he concluded.

Beyond the soundbites, this fight raises a simple question: how much should voters be shown when elected leaders are accused of bungling classified material? Both sides claim the mantle of transparency while accusing the other of weaponizing information. What happens next will matter for how accountability and national-security concerns get balanced in public debates moving forward.
