Former FBI Director James Comey is expected to be indicted in the Eastern District of Virginia in the coming days, MSNBC reported Wednesday, citing three sources.

“The full extent of the charges being prepared against Comey is unclear, but the sources believe that at least one element of the indictment–if it goes forward–will accuse him of lying to Congress during his testimony on September 30, 2020 about whether he authorized a leak of information,” an MSNBC reporter wrote on X.

Comey cultivated a reputation as a moralizer who lectured the country while he was routinely making choices that raised obvious conflicts and questions. Republicans have long argued that his decisions as FBI director were political and often one-sided, and this development would vindicate those concerns if charges are filed and proven. Either way, the spectacle of a top former official facing scrutiny is a necessary corrective to the double standards that have plagued Washington.

There is an almost cinematic irony to the idea that the man who once fancied himself a guardian of the FBI’s honor might now have to answer to the law for his own testimony. That anecdote came off as performative and evasive, and many conservatives saw it as a staged attempt to craft a narrative rather than a frank admission.

The MSNBC report suggests prosecutors are racing against a five-year statute of limitations for lying to Congress, which adds an urgency that is often absent in cases involving officials. CORRESPONDENT CAROL LEONNIG: We have some sources who say that for several weeks now, the U.S. Attorney’s Office in the Eastern District of Virginia, and actually in offices that are potentially much further south than Alexandria, have been eyeing ways to indict Comey, and they are getting very much closer.

They are arguing that Comey… there is evidence to suggest Comey lied to Congress in his testimony on the Hill in September of 2020, and for viewers out in the audience… I’ll just say that there’s a statute of limitations to charge people with the crime of lying to Congress or perjury, and that’s five years. The five-year statute runs this month.

This is a consequential moment for the Department of Justice and for Republicans who have long argued that the law is not being applied evenly. We should be careful not to cheer an indictment simply because it targets someone we dislike, but we should celebrate any move that restores the idea that no one is above the law. If the evidence exists, the case should proceed thoughtfully and transparently.

At the same time, the spectacle around Comey has been fueled by years of performative outrage and theatrical posturing from the man himself, which makes the current attention feel overdue to many conservatives. Accountability cannot be selective, and a prosecution would send a strong message about equal treatment under the law. Americans deserve to know whether a former FBI director misled Congress while he occupied one of the most powerful law enforcement positions in the country.

There are of potential mendacity to sort through, and this is precisely the sort of matter that should be handled through the courts rather than through cable-news revenge. The rules of evidence and the process of indictment exist to separate true accountability from partisan theater, and we should trust that process when it’s followed. If prosecutors have credible proof, we should let the legal process run its course.

For now, watch the calendar and the filings, because this is a time-sensitive window with real consequences for public trust. The conservative argument has always been simple: equal justice, not preferential treatment for the powerful and media-favored. If the DOJ follows the evidence and acts fairly, that will be a win for the country and for the principle that no one is untouchable.

    Let us hope “That Ain’t All!” He needs prosecuted for ‘sedition,’ and conspiracy to enact a coup on a sitting president of the United States. There are other charges, as well, such as falsifying, claiming to be authentic, evidence to a FISA court! This seditious whack should be destined for a long stretch in the Greybar Hotel!
