ICE Moves To Deport Trucker, Facing Homicide Charges Before Trial

The crash that killed a newlywed American couple in Oregon has turned into a fight over whether an accused illegal immigrant will face a homicide trial on U.S. soil or be removed before jurors ever hear the case, touching on sanctuary policies, federal immigration moves, and a grieving family demanding answers.

On Nov. 24, 2025, a semi-truck allegedly jackknifed on U.S. Highway 20 in Bend and struck a Subaru Outback, killing William Micah Carter and Jennifer Lynn Lower, who had been married only 16 days. The truck driver, identified as Rajinder Kumar, was arrested and charged with two counts of manslaughter in the first degree and three counts of recklessly endangering another person. He has pleaded not guilty to all charges and remains the focus of both a criminal case and an immigration enforcement action.

Authorities originally set bail at $500,000, later reduced to $250,000, with Oregon’s release system typically allowing defendants to post roughly 10 percent to secure freedom pending trial. Despite the felony charges, local authorities released Kumar from county custody on Apr. 2, which set off a chain of criticism from federal immigration officials and from the victims’ family. That release is the hinge point for why immigration enforcement later stepped in.

The Department of Homeland Security moved to take custody of Kumar on Apr. 22, and Immigration and Customs Enforcement placed him at the Northwest ICE Processing Center in Tacoma while removal proceedings begin. DHS has described coordination with local officials as conditional, and a DHS spokesperson said, “ICE will work with state and local authorities if they are compliant.” The agency also warned that it will act if local jurisdictions refuse cooperation and follow sanctuary practices.

Kumar’s immigration history, as reported by federal sources, shows he entered the U.S. on Nov. 28, 2022, and received work authorization that allowed him to obtain a commercial driver’s license in California. Those administrative steps happened under the current federal administration’s policies on work permits and parole, and critics argue those policies can have dangerous downstream effects when criminal charges later arise. Supporters of strict immigration enforcement say the case exposes the cost of lax vetting and too-easy access to licenses.

For the Carter family, the larger policy debate is painfully personal. Carter’s mother, Elizabeth, warned that deporting Kumar before a homicide trial would deny victims’ families a chance at justice and said, “By deporting him without going through the homicide trial, he is getting a free pass back to his country, his family, and freedom of life. I believe state and federal law should prohibit anyone from being deported before they face serious criminal charges and, if convicted, serve their time and pay the debt they owe to our society on U.S. soil, before they are deported. Especially when that debt is because an American citizen lost their life on American soil,”

Elizabeth Carter also pushed back on the federal statement about cooperation, telling reporters, “What I read in that statement is … if sanctuary politicians are willing to violate the law, then, and only then, is ICE willing to work with them.” She added, “I’m confused by that,” and said, “I thought our Constitution protects everybody. And I’m surprised that it’s up for negotiation whether or not the United States gets to try the death of two American citizens on U.S. soil.” Her words underline the emotional stakes and the constitutional questions families raise when criminal cases intersect with immigration enforcement.

At the same time Elizabeth made clear she wants fair process for the accused, saying, “I think it’s important that Mr. Kumar be given a chance to defend himself. He’s been publicly called a murderer. A trial is the opportunity for him to present a defense,” She emphasized that victims deserve justice but that “I think Billy and Jenny deserve justice, but so does Mr. Kumar. He deserves the opportunity to present a defense, not just be summarily removed from the country and his reputation trashed.” Those remarks reflect a family trying to balance grief, a demand for accountability, and the legal principle that defendants get a fair day in court.

Federal officials have been blunt about their fallback: “We will not turn illegal aliens over to sanctuary politicians who will release these criminals back onto America[’s] streets. If state and local authorities won’t commit to not releasing him, we will remove him from the country,” That declaration sets up a clash between federal removal authority and local discretion in criminal matters, and it raises questions about where trials will proceed if deportation happens first. Lawmakers on both sides are watching this case as a possible prompt for legislation aimed at ensuring serious criminal charges are resolved before removal.
