The Justice Department is turning up the heat on states that take federal welfare money but do not report known illegal migrants to Washington. Under a new legal opinion released Wednesday, that could put billions of dollars in funding on the line.
The opinion comes from the DOJ’s Office of Legal Counsel and says states tied to two major welfare programs must make sure all relevant state agencies report people known to be unlawfully present to the Department of Homeland Security. That is a big change from the older 1998 interpretation, which limited the duty mostly to the agencies directly running the programs.
For years, the reporting requirement had a narrower reach. If one state office handled the benefits, that office had the obligation, while other agencies that might still know someone’s immigration status, such as colleges or motor vehicle departments, could stay out of it.
Now the administration is pushing a much broader view. The idea is simple: if a state wants the money, it cannot turn around and shield information that helps the federal government enforce immigration law.
Deputy Assistant Attorney General Joshua Craddock put it bluntly, saying, “Failure to comply may lead to serious consequences, including loss of program funding,”
This move fits neatly into President Donald Trump’s tougher immigration agenda. Since returning to the White House, he has kept pressure on both illegal and legal immigration, leaning hard on federal agencies and local partners to tighten the screws.
That push has included federal agents working in cities across the country, raids in migrant communities, and closer coordination with state and local police. Outside companies have also been pulled into the effort as the administration looks for more ways to track down suspected illegal migrants.
The fight is landing hardest in Democrat-led states that have been unwilling to cooperate with immigration enforcement. The administration has repeatedly shown a willingness to threaten federal funds when those states refuse to play ball.
At the center of the dispute are Temporary Assistance for Needy Families and Supplemental Security Income. All 50 states and Washington, D.C., participate in the reporting rules tied to those programs, and the money involved is enormous.
Federal TANF grants top $16.5 billion each year, while Supplemental Security Income federal benefits exceed $60 billion annually. The DOJ says illegal migrants are not eligible for either program, which makes the reporting fight even more politically charged.
The new interpretation is almost certain to spark another round of courtroom battles. Democrat-led states have already sued to block DHS from gathering personal information on people receiving benefits under TANF, arguing the federal government is overreaching.
Judges have sometimes limited earlier efforts by the administration to force information sharing, but not every challenge has gone the same way. In some cases, federal immigration authorities have been allowed to collect specific data, including Medicaid information, which keeps the legal ground moving under everyone’s feet.
The broader message from Washington is hard to miss. States that take federal welfare dollars may soon have to choose between keeping that funding flowing and continuing to stonewall federal immigration authorities, and that choice is exactly what is driving the new clash.
