US Olympian Indicted For Allegedly Damaging Lincoln Memorial Pool

The Justice Department says a former U.S. Olympian has been indicted after an incident at the Lincoln Memorial reflecting pool, with prosecutors calling it deliberate damage and the athlete insisting he did nothing wrong. The case touches on restoration work done ahead of the nation’s 250th and a string of related Park Service incidents now under review.

A federal grand jury returned an indictment charging David Hearn, 67, after authorities say he willfully damaged the pool’s liner following recent restoration work. Prosecutors describe a two-square-foot section of sealant being ripped up on June 19, and they say the act was witnessed by National Park Service staff who confronted him as it happened. The indictment elevates the matter to a felony that carries serious potential penalties if convicted.

“Today a grand jury has returned a felony indictment against a defendant, David Hearn, for felony destruction of property for which he faces 10 years in prison,” Pirro in a media briefing. U.S. Attorney Jeanine Pirro has publicly framed the charge in stark terms while officials continue to review evidence and statements from those on site. The language used by the office signals a decision to pursue a strong charge rather than a lesser offense.

According to the Park Service account, employees saw Hearn reach into the pool and use both hands to pull up and remove the bottom liner. Staff members reportedly asked him to stop, and prosecutors say he responded loudly and confrontationally to a Parks employee. Witnesses characterized his conduct as “belligerent, rude, and disrespectful,” and those descriptions factored into the decision to pursue criminal charges.

Hearn denies the accusations and told the Washington Post he did not damage the reflecting pool, offering a compact but pointed account of his arrest. “I didn’t vandalize anything,” he said. “I didn’t destroy or break or peel anything. By the time I realized what was going on, I was being put in handcuffs.” That latter line was quoted exactly by multiple outlets and is central to Hearn’s public defense of his actions on the day in question.

The reflecting pool itself had recently undergone restoration ordered ahead of the country’s 250th anniversary, a project that drew both praise and criticism in public debate. Some critics mocked the effort, while others defended it as sensible maintenance of an important national monument. Regardless of opinion about the renovation, officials say the park’s restoration team had worked to return the pool to shape and that staff witnessed the alleged removal of the liner.

Pirro told reporters the government is also looking into roughly half a dozen other incidents tied to damage at the National Mall, and she said those matters are being sorted out by severity. “Some of them will be misdemeanors, and some of them could be less, like a violation, but we’re reviewing every case based upon the evidence and reviewing all of the reports, and right now it’s about another half dozen misdemeanors,” Pirro said. The statement suggests prosecutors are distinguishing between isolated, minor acts and what they consider to be intentional, criminal destruction.

Hearn is not a stranger to public attention: he represented the United States as a canoeist at the 2000 Olympics, a credential that made the case all the more notable when his name surfaced in media reports. Legal experts say the coming weeks will likely bring motions, discovery and possibly negotiations if either side seeks to avoid a trial. For now the indictment marks a formal escalation, and the Park Service and U.S. Attorney’s Office appear committed to following the evidence where it leads.
