Five West Virginia Middle School Students Banned from Future Competitions for Refusing to Compete Against Transgender Athlete in Track Event

Five middle school students from West Virginia have been barred from participating in future track and field competitions for refusing to compete against a transgender athlete.

The situation has captured the attention of state Attorney General Patrick Morrisey, who is making a second attempt to involve the US Supreme Court.

The focal point of the controversy is the “Save Women’s Sports Act” (House Bill 2917), which came under scrutiny on April 16th following a lawsuit filed on behalf of Becky Pepper-Johnson, a 13-year-old transgender (biological male) middle school track athlete.

The legal challenge asserted that the law, which prevents transgender students from joining sports teams that correspond with their gender identity, violates both the Equal Protection Clause and Title IX. Title IX aims to combat sex-based discrimination in education.

In his ruling,  Judge Toby Heytens wrote, “Offering B.P.J. a ‘choice’ between not participating in sports and participating only on boys teams is no real choice at all. The defendants cannot expect that B.P.J. will countermand her social transition, her medical treatment, and all the work she has done with her schools, teachers, and coaches for nearly half her life by introducing herself to teammates, coaches, and even opponents as a boy.”

At the 2024 Harrison County Middle School Championships on April 18th, five students from Lincoln Middle School chose not to participate in the shot-put competition as a form of protest against competing with Becky Pepper-Jackson, a transgender student whose right to compete had been affirmed by the Fourth Circuit Court of Appeals.

The girls symbolically entered the shot-put circle but then stepped out, forfeiting their turns to make their stance clear.

This protest was also repeated during the discus event, which Pepper-Jackson went on to win.

West Virginia Attorney General Patrick Morrisey, who is running for governor, stood in solidarity with the protesting students, highlighting their peaceful demonstration against a federal court ruling that they feel threatens the fairness of women’s sports.

“At its core, this is a matter of common sense,” Mr. Morrisey said Wednesday at a press conference. “You can’t fairly ask a girl or a woman to compete against a biological male. It’s not right, and it’s just plain wrong, and West Virginia parents know this.”

Morrisey has filed an amicus brief backing the students after they were banned from future events and announced plans to urge the Supreme Court to review the state’s regulations concerning transgender student-athletes.

“I will do everything in my power to defend these brave young girls. This is just wrong. We must stand for what’s right and oppose these radical trans policies,” Morrisey said on Monday.

“What does it mean to fight and win? We announced this week that we are taking our fight to protect girls’ sports all the way to the U.S. Supreme Court. That is what fighting means. And I know we will win this fight,” Morrisey wrote on X.

    All real girls should quit all girls sports, and let the boys play against themselves Acting as girls. Make the school and government look stupid as hell. Their never going to win against boys anyway. So what’s the point of trying.,

    There are only two sexes male and female. Those that think differently are in my humble opinion seriously confused. Even if a human spends lots of money to augment their appearance their chromosomes still state their original sex. Further, why is it that over 60% of those that choose to spend all sorts of money mostly it’s not theirs to change their bodies commit suicide ? Again not trying to anger or upset anyone if I was trying everyone would know that was my intent.

    So men who think they are women, despite common sense and science, under the Biden (Big Brother) administration are women and don’t you dare question it. And if you do, you’ll be punished.
